Terms and Conditions for Open Film Collective Ltd. Raffle

A percentage of proceeds of this lottery will be paid to RaffleTix Holdings Pty Ltd as a professional fundraiser.

1. Introduction

1.1. The raffle ("Raffle") is conducted by Open Film Collective Ltd. ("Promoter"), a not-for-profit organisation dedicated to supporting the advancement of culture through art, including film and other media.

1.2. The Raffle will be conducted electronically through the RaffleTix online platform.

1.3. The funds raised from the Raffle will be used to support the advancement of culture through supporting art, including film and other media.

1.4. This Raffle is governed by the laws of South Australia, and participants submit to the exclusive jurisdiction of the courts of South Australia.

1.5. This raffle is conducted in accordance with the relevant fundraising and gaming laws of each eligible state and territory.

2. Raffle Details

2.1. Raffle Licence and Permit Numbers:

• Western Australia: Licence No. LS223012525

2.2. Raffle Timeline:

• The Raffle will open for ticket sales at 9:00am ACST on 7th April 2025 and close at 9:00am ACST on 19th May 2025.
  • The draw will be held at 12:00pm ACST on 19th May 2025 at 1 Mulberry Road, Glenside SA 5065, or remotely, subject to business requirements.

2.3. Winner Notification & Publication:

• Winners will be notified within 21 days of the draw by phone and registered mail.
• Results will be published on the Open Film Collective website and:
  • The Advertiser (SA) on June 2, 2025 (14 days after the draw).
  • The West Australian (WA) on June 2, 2025 (14 days after the draw).
• All entrants are responsible for checking these publications for results.
• If a winner does not respond within 30 days of initial notification, the Promoter may take reasonable steps to locate the winner before applying the prize to the organisation’s purpose.

2.4. Ticket Pricing & Availability:

• Single ticket pricing is $10.
• The maximum number of tickets available will be 2,500.
• Once purchased, raffle tickets are non-refundable, unless required by law.
• If a ticket purchase is deemed invalid, duplicated, or over the maximum ticket limit, the Promoter reserves the right to cancel the purchase and refund the buyer accordingly.
• It is the entrant’s responsibility to ensure the safekeeping of their ticket purchase confirmation. The Promoter is not responsible for lost, stolen, or misplaced tickets.

3. Prizes

3.1. First Prize:

• $5,000 cash.

3.2. Prize Distribution:

• All prizes will be electronically transferred to winners within 30 days of the draw date.
• Winners must provide valid proof of identity and residence (such as a driver’s license or passport) before the prize is issued.
• Open Film Collective Ltd. is not responsible for any banking or transaction fees associated with the electronic transfer of prizes.
• Any applicable taxes or duties on prizes are the sole responsibility of the winner. The Promoter is not responsible for any tax implications.
• Winners are responsible for providing accurate banking details and any necessary documentation required to claim their prize. The Promoter is not responsible for delays caused by incomplete or inaccurate information.

3.3. Unclaimed Prizes:

• Unclaimed prizes will be kept for one year from the draw date. If unclaimed, the prize or proceeds will be applied to the association’s purpose.

4. Eligibility

4.1. Entrant Age Requirement:

• Entrants must be 18 years of age or older.

4.2. Eligible States & Territories:

• Entry is open to residents of:
  • Queensland
  • New South Wales
  • South Australia
  • Western Australia
  • Tasmania

4.3. Excluded Persons:

• Entry is not open to members of the Open Film Collective board, employees, agents, and their immediate families.

4.4. Winner Eligibility Verification:

• It is the responsibility of all entrants to ensure they are eligible to accept the prizes offered.
• If a winner is deemed ineligible, the prize may be forfeited and a redraw may occur.

5. General Terms

5.1. Right to Cancel or Modify:

• Open Film Collective Ltd. reserves the right to cancel any draw at any time for any reason and to disqualify entries for non-compliance with these Terms.
• In the event of cancellation, all purchased tickets will be refunded unless required otherwise by law.

5.2. Liability Disclaimer:

• Open Film Collective Ltd. is not liable for any loss or damage suffered as a result of claiming or taking any prizes, except for liability that cannot be excluded by law.

5.3. Privacy Policy:

• All entrant details will be handled in accordance with Open Film Collective Ltd.’s privacy policy.
• Personal data will not be sold or shared with third parties, except as required by law.
• All payments are securely processed via RaffleTix, which uses Stripe for credit card transactions, and no credit card information is stored by the Promoter.
• While RaffleTix facilitates ticket purchases and transactions via Stripe, Open Film Collective Ltd. is not responsible for any service interruptions, technical failures, or payment processing issues.

5.4. Dispute Resolution:

• Any disputes regarding the raffle will be resolved at the sole discretion of Open Film Collective Ltd. in accordance with applicable laws.

5.5. Tax Deductibility:

• Raffle tickets are not tax-deductible donations. Participants are advised to seek independent tax advice regarding their winnings.
